In June 2025, the Circuit Court of the First Circuit in the State of Hawaii granted dismissal in favor of our foreign-based manufacturer clients Maxsun (Dalian) Co., Ltd. and Maxsun Co., Ltd. (collectively, “Maxsun”). Following jurisdictional discovery and extensive briefing, the Court held that Plaintiffs failed to demonstrate that the Court can exercise personal jurisdiction over Maxsun in the State of Hawaii. Specifically, the Court found that, based on existing precedent of the U.S. Supreme Court, Hawaii Supreme Court and lower state and federal courts, Plaintiffs failed to establish that Maxsun purposefully availed itself of the privilege of conducting activities in the forum of Hawaii.
